These Terms of Service ("Terms") describe your agreement with Over Easy Worldwide, LLC when using our Services. By accessing or using our Services, you agree to be bound by these Terms.

We may update these Terms from time to time. When we do, we'll update the date above and notify you if deemed appropriate.

Definitions

"Company," "we," "our," "us," or "Over Easy Worldwide" refers to Over Easy Worldwide, LLC, a New York limited liability company.

"Services" refers to all websites, applications, and products operated by Over Easy Worldwide, LLC, including Big Sort (bigsort.app), and any other products we make available.

"You" or "your" refers to individuals who use our Services.

Account Terms

You're responsible for maintaining the security of your account and password, and for all activity under your account. We are not liable for any loss or damage resulting from your failure to protect your account.

You must be at least 13 years old to use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You must provide accurate information when creating an account. Accounts registered by automated methods are not permitted.

Your Content

You retain ownership of any content you create through our Services.

We do not claim any ownership rights over your content. However, by using our Services, you grant us a limited license to store, display, and process your content solely for the purpose of providing the Services to you.

Your content is private by default. We do not share your content with other users or third parties except as described in our Privacy Policy.

You are responsible for the content you create. You agree not to use our Services for any unlawful purpose or to violate any laws in your jurisdiction.

Our Content and Intellectual Property

The Services, including all software, design, and other materials, are owned by Over Easy Worldwide and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services, or reverse engineer our software, without our written permission.

"Over Easy Worldwide," "Big Sort," and associated logos are trademarks of Over Easy Worldwide, LLC.

Acceptable Use

You agree not to misuse our Services, including attempting to access other users' data, interfering with our systems, transmitting malware, or using automated means to access the Services without permission.

We may suspend or terminate your access if we believe you are violating these terms or using the Services in a way that could harm us or other users.

Account Termination

You may delete your account at any time through the account settings in the app. When you delete your account, all of your data is permanently deleted from our systems.

We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we discontinue the Services.

Changes to the Services

We may modify, update, or discontinue any part of the Services at any time. If we discontinue a Service entirely, we will make reasonable efforts to give you advance notice and an opportunity to export your data.

Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the Services will be uninterrupted or error-free.

We make no warranties about the accuracy, reliability, or completeness of any content or information provided through the Services.

Limitation of Liability

To the maximum extent permitted by law, Over Easy Worldwide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Services.

Our total liability shall not exceed fifty dollars ($50) or the total amount you paid us in the twelve months preceding the claim, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Over Easy Worldwide, LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.

Governing Law

These Terms are governed by New York law. Any disputes will be resolved in the state or federal courts located in New York County, New York.

General Terms

If any provision of these Terms is unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and Over Easy Worldwide regarding the Services.
